Privacy Policy

EZProvider Networks Inc. (“EZP”) provides website hosting, technical support services, domain name registrations, SSL certificates, anti-spam services and back-up services (the “Service”) to subscribers (our “Customers”) and their employees or other representatives (“Representatives”). EZP also publishes and maintains a website at http://ezp.net (the “Website”), which may be viewed by “Viewers”. In order to provide and maintain the Service and the Website, EZP may collect, use and disclose information that identifies you as an individual (your “Personal Information”). This policy sets out how EZP collects, uses and discloses the Personal Information pertaining to Customers, Representatives and Viewers, each of whom are a “User”. If you are a Customer, Representative or Viewer, this policy applies to you and your Personal Information.
1. Consent
When you view the Website, register for an account, create a username and password and/or use the Service, you may be providing to EZP your Personal Information. By viewing the Website, registering for an account, creating a username and password, accepting the Hosting Agreement and/or using the Service, you consent to the collection, use and disclosure of your Personal Information by EZP in accordance with this policy, and you represent and warrant that you have obtained consent from any other person whose Personal Information you may provide to EZP. If you do not consent to the collection, use and disclosure of your Personal Information, or do not have consent to collect, use and disclose Personal Information of others, in accordance with this policy, do not view the Website, register for an account, create a username and password, accept the Hosting Agreement or use the Service.
2. Collection, Use and Disclosure of Personal Information
Any Personal Information regarding Customers or Representatives that is provided to EZP may be used for the purposes of providing, maintaining and developing the Service, processing payment for subscription to the Service, providing technical support, and other purposes reasonably connected to these.
EZP may use Personal Information regarding Customers or Representatives to contact Customers or Representatives from time to time regarding the Service, but will not provide such Personal Information to third parties for marketing or spamming purposes.
EZP may collect, use or disclose Personal Information without the User’s knowledge or consent in the following circumstances: when the collection, use or disclosure is permitted or required by law; in an emergency that threatens an individual’s life, health, or personal security; when the Personal Information is available from a public source; when EZP requires legal advice from a lawyer; for the purposes of collecting a debt; to protect EZP from fraud; and, to investigate an anticipated breach of an agreement or a contravention of law.
Personal Information may be transferred to third parties for the purpose(s) of hosting the websites; data storage; providing technical support; troubleshooting, management or maintenance of the Service; or other purposes reasonably connected to these. These third parties may be located in other provinces in Canada.
Personal Information may be disclosed to third parties for the purpose of negotiating financing, a merger, an amalgamation, or a sale of the business or assets of EZP (each a “Business Transaction”). Personal Information may be transferred to a third party in a Business Transaction involving EZP.
EZP may use “Cookies” to track Viewers’ visits to the Website and referrals from other websites. A cookie is a small file stored on your computer by your web browser when using some internet sites. Cookies can also store non-personal information. EZP does not link non-personal information from Cookies to your Personal Information.
3. Access to Your Personal Information
You may access your Personal Information that is under EZP’s control by submitting a written request to EZP’s Privacy Officer. With certain exceptions, within 30 days of receiving your written request, EZP will provide:
o a summary of your Personal Information that is under EZP’s control;
o the ways in which your Personal Information has been used by EZP; and
o the names of any individuals or organizations to whom EZP has disclosed your Personal Information.
You may address any concerns about any of your Personal Information under EZP’s control by submitting a written request to EZP’s Privacy Officer detailing such concerns.
4. Withdrawal of Consent
You may withdraw your consent to EZP’s use and disclosure of your Personal Information by making a written statement to EZP’s Privacy Officer. Upon receiving such written statement, within a reasonable amount of time, EZP will make reasonable efforts to delete or render anonymous your Personal Information that is under its control. This may result in your inability to access the Service and/or deletion of your account.
5. No Control over Other Users’ Compliance with Privacy Laws
The access provisions in section 3 and the withdrawal of consent provisions in section 4 of this policy apply only to Personal Information that is under EZP’s control. EZP is not responsible for any Personal Information that is not under its control, including any Personal Information that has been disclosed to other Users that have access to an account. If you want to access, correct, or withdraw your consent to the use and disclosure of any Personal Information that is under the control of another User, you must contact the User directly.
